Moodle Workplace™ is Moodle's customised enterprise learning and training management system only available via Moodle Pty Ltd or Moodle group company ("Moodle") or a Moodle Certified Premium Partner. The Moodle Workplace™ code is a collection of software scripts (plugins and modifications, and any derivations thereof) that are exclusively owned and licensed by Moodle under the terms of a separate Moodle Workplace Agreement and/or Customer Terms.
It is made available with Moodle's open source software ("Moodle LMS") which is freely downloadable at "download.moodle.org" and which is provided by Moodle under a single GNU General Public License version 3.0, dated 29 June 2007 ("GPL"). The Moodle LMS software is distributed in the hope that it will be useful, but without any warranty; including but not limited to the implied warranty of merchantability or fitness for a particular purpose.
If you are accessing Moodle Workplace™ without written permission it is unauthorised access and you should delete it and all accompanying documentation immediately. Failure to do so will expose you to legal penalties. By accessing Moodle Workplace™ in accordance with the Moodle Workplace Agreement and/or Customer Terms you agree that you have signed either the Moodle Workplace Agreement and/or Customer Terms with a Moodle Certified Premium Partner or Moodle ensuring (among other things) that you will:
- only access and share Moodle Workplace™ in accordance with the terms of the applicable Moodle Workplace Agreement or applicable Customer Terms including without restriction all indemnities and promises of confidentiality in Moodle's favour therein;
- ensure each Moodle Workplace™ production instance is accurately registered in the site registration hub provided, as described in https://docs.moodle.org/en/Site_registration;
- register accurate Customer details in the Moodle Partner Portal including the URL and the location of hosting and for Customer-Hosted instances, ensure the Customer Terms are properly and lawfully executed by the Customer and returned to Moodle together with providing a copy of the Customer's commercial general liability insurance coverage;
- ensure that all production sites are upgraded to a version of Moodle Workplace Code confirmed by Moodle as currently supported by bug fixes for security vulnerabilities as stated by Moodle publicly on its website; and
- cease using Moodle Workplace™ and immediately delete all copies of the Moodle Workplace™ Code from your servers and any computers under your control if you are no longer a Moodle Certified Premium Partner or a customer of a Moodle Certified Premium Partner. You must confirm this in writing to Moodle within 7 days of such event.
Moodle Workplace™ websites may include a tracking pixel for statistical purposes and compliance monitoring. Please note that no personal data is collected or processed.
